The ToS affect the usage of Playary mobile Application, desktop Application and our website ("Playary", "Services", "Software"). Please read our ToS and Privacy Policy carefully before using any of the Playary Services. Please note: these Terms of Service, together with our Privacy Policy constitute a legal agreement, which is a contract ("Agreement") between you and Playary, concerning the usage of Playary services. Playary reserves the right to amend these Terms at any time and without notice. Any revisions to the Terms will be posted on the Playary website. By continuing to access or use our Services, you accept any changes or revisions to the Terms.
In order to use the Playary Services and access the content you need to be (1) 13 or older or have your parent or guardian’s consent to the Agreement, (2) have the power to enter an Agreement with us and not be barred from doing so under any applicable laws, and (3) be resident in a country where YouTube services are available.
Playary is a Music and Movie Player that supports playback of YouTube videos ("YouTube content"). You can search, like, share and add videos/tracks to playlists within the app. The Service is provided solely for your own non-commercial use. In order to access YouTube content, you must be connected to the internet. The cost of the data connectivity service may vary among service providers. It is your responsibility to review such costs and to determine whether you wish to bear such costs or not. In particular, you further acknowledge that the cost of such data connectivity service may rise significantly when roaming internationally. Therefore, you are advised to consider the cost of using the Service, depending on your location at any particular time.
You agree to the following points while accessing or using Playary: (1) You may not infringe the intellectual property rights, proprietary rights, or rights of publicity or privacy of any third party (2) You may not use Playary Music and Movie for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (3) You may not transmit, transfer any unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene, or otherwise objectionable or harmful information of any kind (4) You may not disseminate, transfer any code, files or software that contains a virus, worm, time bomb, Trojan horse, or other harmful or disruptive component that can interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment, violate the security of any computer network, or the like.
PLAYARY IS PROVIDED “AS IS”, "AS AVAILABLE" AND "WITH ALL FAULTS" WITHOUT WARRANTY OF ANY KIND. HYTAG, INC HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. FURTHER, HYTAG, INC DOES NOT WARRANT AGAINST ERRORS, OMISSIONS, RESULTS OF USE, OR THAT OUR SOFTWARE AND THE INCLUDED THIRD PARTY SOFTWARE IS FREE OF ERRORS, FREE OF MALWARE OR OTHER HARMFUL COMPONENTS, OR THAT USE WILL BE UNINTERRUPTED. IN ADDITION, HYTAG, INC MAKES NO REPRESENTATION NOR DOES IT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY THIRD PARTY CONTENT OFFERED THROUGH PLAYARY. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT. YOU USE PLAYARY AT YOUR OWN RISK. ALL THE FOREGOING DISCLAIMERS ALSO APPLY IN FULL WITH RESPECT TO HYTAG INC'S LICENSORS, AND THIRD PARTY CONTRIBUTORS.
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, SHALL PLAYARY BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, COMPUTER FAILURE OR MALFUNCTION, LOSS OF DATA, OR OTHER DAMAGES OF ANY NATURE ARISING OUT OF OR IN CONNECTION WITH THE USE OF PLAYARY MUSIC AND MOVIE PLAYER. PLAYARY SHALL HAVE NO LIABILITY FOR ANY FAILURE OR DELAY DUE TO MATTERS BEYOND THEIR REASONABLE CONTROL. THE FOREGOING SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
Playary does not have or maintain any control over Third Party Services and therefore is not and cannot be responsible for their content. By pointing or otherwise providing access to external services, Playary makes no warranty or does not expressly or implicitly endorse, in relation to the legality, the accuracy, the quality or the authenticity of the content, information or services provided by these external services.
