This Advertising Policy ("Policy") applies to all advertising services purchased on playary.com, a platform operated by PLAYARY YAZILIM DONANIM BİLİŞİM TİCARET TAAHHÜT VE SANAYİ LİMİTED ŞİRKETİ ("Playary", "we", "us", or "our"), including self-service advertising campaigns for podcasters, artists, and other content creators. By purchasing advertising services through our platform, you ("User" or "you", or "Advertiser") agree to the terms outlined in this Policy.
Our Advertising Ecosystem
Playary's advertising platform operates across multiple touchpoints to maximize reach and engagement:
- Multi-Platform Reach: Advertisements are delivered across our web platform, iOS mobile and tablet applications, and Android mobile and tablet applications
- Targeted Audience: Our user base consists of podcast listeners, music enthusiasts, and audio content consumers actively seeking new entertainment
- Creator-Focused Environment: Ads are displayed within a context specifically designed for audio entertainment discovery and consumption
- Self-Service Platform: Advertisers have full control over campaign creation, content submission, and scheduling through our user-friendly interface
Weekly Campaign Structure
All advertising on Playary operates on a weekly booking system, providing advertisers with predictable scheduling and clear campaign periods. Each weekly campaign is treated as an independent purchase with specific start and end dates.
Content Standards Commitment
As a platform dedicated to quality audio entertainment, Playary maintains strict editorial standards to ensure all advertising content aligns with our community values and enhances the user experience rather than detracting from it.
No Refund Policy
All advertising purchases on playary.com are final and non-refundable. Once payment is processed for any advertising service, including but not limited to:
- Weekly self-service ad campaigns
- Promoted content placements
- Featured artist listings
- Weekly podcast promotion packages
- Premium advertising slots
No refunds, credits, or chargebacks will be issued except in cases of technical problems as outlined in the Technical Problems section below.
Self-Service Advertising Terms
Weekly Campaign Structure
- All advertising campaigns are sold and booked at weekly intervals
- Each weekly ad placement is treated as a separate, distinct purchase
- Advertisers can book multiple consecutive weeks but each week is billed and fulfilled independently
- Weekly campaigns run from Monday to Sunday unless otherwise specified
Campaign Management
- Advertisers are solely responsible for creating, managing, and monitoring their weekly advertising campaigns
- All campaign settings, targeting parameters, creative content, and scheduling are set by the advertiser
- Playary provides the platform and tools but does not guarantee campaign performance, reach, or results
- Changes to active weekly campaigns may not be possible once the campaign week has begun
Booking and Scheduling
- Weekly ad slots are subject to availability and are allocated on a first-come, first-served basis
- Premium placement slots may have limited availability and higher pricing
- Advertisers must book campaigns in advance; same-week bookings are not guaranteed
- Scheduled campaigns that have not yet started may be cancelled or modified at Playary's discretion
Editorial Vetting and Content Standards
Content Review Process
- All advertising content is subject to editorial review and approval before going live
- Review process typically takes 24-48 hours but may take longer during peak periods
- Playary reserves the right to reject any advertising content that does not meet our standards
- No refunds will be issued for content review rejections under any circumstances
- When an ad is rejected, Playary will send an email to the advertiser explaining what needs to be corrected
- Advertisers must revise and resubmit compliant content to proceed with their campaign
- Multiple rejections of the same campaign may result in forfeiture of payment without refund
- Advertisers are responsible for ensuring their content meets all guidelines before submission
Playary reserves full discretion in determining the acceptability of advertising content. All editorial decisions are final. No refunds will be provided in cases where content is rejected for failing to meet editorial standards.
Content Standards and Guidelines
- All advertising content must be relevant to podcasting, music, or audio entertainment
- Content must be truthful, accurate, and not misleading
- Advertisements must clearly identify the advertiser and not impersonate others
- All claims made in advertisements must be substantiated
- Content must comply with applicable advertising standards and regulations
Prohibited Content
Advertising content containing the following is strictly prohibited and will result in immediate campaign rejection without refund:
- Sensitive, offensive, or inappropriate material
- Hate speech, discriminatory content, or harassment
- Adult content, nudity, or sexually explicit material
- Violence, illegal activities, or dangerous behavior
- Misleading claims, false information, or fraudulent content
- Copyright infringement or unauthorized use of intellectual property
- Content that violates local, national, or international laws
- Spam, malware, or deceptive practices
- Illegal downloads, piracy, or copyright violation tools
- Weapons, drugs, or other regulated substances
- Political advertising or campaign content (subject to platform discretion)
- Gambling or betting services
- Multi-level marketing or pyramid schemes
- Financial or personal information (e.g., credit card numbers, social security numbers)
- Defamatory content or libelous statements
- Content that incites violence or promotes self-harm
Tax and VAT Considerations
Tax Responsibility
- All advertiser payments are exclusive of applicable taxes, VAT, or other governmental fees
- Playary may collect and remit VAT or other taxes as required by law. Our payment processing services are exclusively handled by Paddle, a recognized merchant of record. This means that Paddle is responsible for managing all aspects of the transaction, including the collection and remittance of Value Added Tax (VAT) when applicable. By leveraging Paddle's robust platform, we ensure compliance with international tax regulations, simplifying the purchasing experience for our customers while maintaining legal and financial integrity.
- Tax-related disputes do not qualify for refunds. Our advertising policy explicitly states that tax-related disputes are not eligible for refunds. This includes sales tax, VAT, import duties, customs fees, and any other government levies. Customers are solely responsible for understanding and complying with their jurisdiction's tax laws. We strongly advise consulting a tax professional and researching applicable laws before purchase. Refunds will be denied for misunderstandings or misinterpretations of tax charges. This policy ensures legal compliance, fairness, operational efficiency, and prevents abuse. While we provide clear pricing, tax compliance rests with the customer; due diligence and expert advice are encouraged.
International Transactions
- VAT rates and tax obligations vary by country and region
- Advertisers outside the platform's primary jurisdiction remain subject to the no-refund policy regardless of local tax implications
- Playary is not responsible for any additional tax obligations incurred by advertisers in their local jurisdictions.
Account and Service Issues
Technical Problems
- Refund Eligibility:
- Technical problems on Playary's platform that prevent ad delivery during a booked weekly period may qualify for refunds at Playary's sole discretion
- System outages lasting more than 24 hours during an active campaign week may result in partial or full refunds
- Technical issues must be reported within 7 days of the affected campaign week
- Minor technical difficulties, brief outages, or maintenance windows do not qualify for refunds
- Playary will make reasonable efforts to resolve technical issues promptly
- Refunds for technical problems will be processed as credits to the advertiser's account or original payment method
- Documentation of technical issues and their impact on ad delivery may be required for refund consideration
Account Violations
- Advertisers whose accounts are suspended or terminated for policy violations forfeit all paid advertising funds
- No refunds will be issued for campaigns affected by account enforcement actions
- Repeated violations may result in permanent account suspension and forfeiture of all future bookings
- Advertisers are responsible for maintaining account security and compliance with platform terms
Performance and Delivery
- Playary does not guarantee specific campaign results such as impressions, click-through rates, or conversions
- Actual ad performance may vary based on audience engagement, content quality, and market conditions
- Refunds will not be issued based on underperformance or perceived lack of results.
- Advertisers are encouraged to optimize their content and targeting for better results
Ad Placement and Visibility
- Weekly ad placements are delivered according to available inventory and platform algorithms
- Premium placements may receive higher visibility but performance is not guaranteed
- Ad rotation and frequency are managed by Playary's systems and cannot be customized by advertisers
- Competing ads in similar categories may affect individual campaign visibility
Platform Distribution and Display
Advertisements are displayed across Playary's multi-platform ecosystem including:
- Web Platform: Ads appear on Playary website across desktop and mobile browsers
- iOS Mobile App: Native ad placements within the iPhone application
- iOS Tablet App: Optimized ad formats for iPad devices
- Android Mobile App: Native ad placements within Android smartphone applications
- Android Tablet App: Tablet-optimized ad formats for Android tablet devices
Cross-Platform Ad Delivery
- All weekly campaigns automatically distribute across available platforms based on user activity
- Ad formats are automatically optimized for each platform's specifications and user experience
- Distribution ratio between platforms depends on user engagement patterns and cannot be controlled by advertisers
- Some ad formats may perform differently across platforms due to device capabilities and user behavior
- Platform-specific technical limitations may affect ad display on certain devices or operating system versions
Device and Platform Considerations
- Ad visibility may vary based on device screen size, resolution, and operating system version
- Mobile apps may have different ad placement locations compared to web platform
- Network connectivity and device performance can impact ad loading and display quality
- Platform updates, app store policies, or operating system changes may temporarily affect ad delivery
- Users' device settings, ad blockers, or privacy preferences may impact ad visibility across platforms
Delivery Confirmation
- Playary will provide delivery confirmation once ads are live on the platform
- Basic analytics and performance data may be available through the advertiser dashboard
- Detailed reporting beyond standard metrics is not guaranteed
- Third-party verification of ad delivery is not provided
Audience and Reach
- Target audience availability fluctuates based on platform traffic and user engagement
- Seasonal variations, holidays, and external factors may impact audience size and engagement
- Demographic targeting is based on available user data and may not be 100% accurate
- International audience reach may vary by region and content language
Content Performance Factors
- Ad performance is influenced by creative quality, relevance, and timing
- Podcast and music industry trends may affect campaign effectiveness
- User behavior patterns and platform algorithm changes can impact delivery
- Advertisers should consider A/B testing different creative approaches for optimal results
- Playary does not provide A/B testing tools but encourages advertisers to manually test different creatives across separate campaign weeks.
Platform Changes
- Playary may update advertising formats, placement options, or delivery methods
- Algorithm changes or platform improvements may affect existing campaign performance
- New features or modifications will be communicated through official channels
- Existing campaigns may be affected by platform updates without qualifying for refunds
- Any changes to ad formats or platform features during an active campaign do not entitle the advertiser to refunds, unless the changes result in a material failure to deliver the service
- Playary shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war, government restrictions, internet outages, or other force majeure events
Payment and Billing
Payment Processing
- All payments must be completed before campaign activation
- We use Paddle, a secure third-party processor, for all transactions, ensuring efficient and secure financial data handling according to global protocols.
- Accepted payment methods include major credit cards and approved digital payment platforms
- Failed payments will result in campaign cancellation without penalty to Playary
- Partial payments do not reserve ad slots or guarantee campaign delivery
- Third-party payment processor fees and policies may apply to transactions
- Refunds, when applicable, will be processed through the same third-party payment processor used for the original transaction
Billing Disputes
- Billing disputes must be reported within 30 days of the charge
- All billing inquiries should be directed to official Playary support channels
- Unauthorized chargebacks may result in account suspension and legal action
Dispute Resolution
Internal Process
- All refund requests or disputes must be submitted through official Playary support channels
- Disputes will be reviewed according to this policy, with final decisions made at Playary's discretion
- Response times for dispute reviews are not guaranteed
External Disputes
- Chargebacks or payment disputes initiated through financial institutions will be contested
- Successful chargebacks may result in account suspension or termination
- Legal fees and administrative costs may be pursued for frivolous disputes
- Playary reserves the right to seek reimbursement for legal fees and costs associated with defending unjustified or fraudulent disputes
Jurisdiction and Governing Law
This Advertising Policy and all matters arising out of or relating to it shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law principles.
Legal Jurisdiction
- Any legal action, suit, or proceeding arising out of or relating to this Policy, the advertising services, or refund disputes shall be brought exclusively in the courts located in Ankara, Türkiye.
- All parties hereby consent to the exclusive jurisdiction and venue of such courts.
- Users waive any objection to the laying of venue in such courts and waive any claim that such venue is an inconvenient forum.
International Users
- Users accessing our services from outside Türkiye acknowledge and agree that they are subject to Turkish law and jurisdiction, regardless of their location.
- Local laws in the user's jurisdiction do not override the terms of this Policy.
- Users are solely responsible for ensuring compliance with any local laws applicable in their jurisdiction while using our services.
Language and Translation
- This Policy is originally drafted in English and shall be the controlling version
- Any translations provided are for convenience only and may not reflect the precise terms of the English version
- In case of any discrepancy between translations and the English version, the English version shall prevail
Enforcement and Severability
- If any provision of this Policy is found to be unenforceable or invalid under Turkish law, such provision shall be limited or eliminated to the minimum extent necessary
- The remainder of this Policy shall remain in full force and effect
- The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent
Limitation Period
- Any claims or disputes arising under this Policy must be commenced within one (1) year after the cause of action arises
- Failure to bring claims within this period shall result in such claims being permanently barred
Legal Costs
- In the event of any legal proceeding arising from this Policy, the prevailing party shall be entitled to recover reasonable attorneys' fees and court costs from the non-prevailing party
- This provision applies to all disputes, including but not limited to refund claims, billing disputes, and breach of contract claims
Policy Updates and Changes
Playary reserves the right to modify this Advertising Policy at any time. Changes will be effective immediately upon posting to the website. Continued use of advertising services constitutes acceptance of any policy modifications.
